SUBMISSION POLICY
By submitting your Accessipals™ Submission, you acknowledge, understand, and agree to the following:
Schoolyard Fun Productions is not obligated to use your Submission in any manner, nor do we have an obligation to contact you regarding the Submission. Schoolyard Fun Productions may decline it for any reason.
You understand, acknowledge and agree that Schoolyard Fun Productions is accepting the Submission at your request, which request was and is deemed to have been made by you, knowing that there are or may be Accessipals™ materials which may be similar in subject matter, substance and/or other elements to those found in the Submission. You further understand, acknowledge and agree that SYF may also, in the future, develop new material/ and or projects which may be similar in subject matter, substance and/or other elements to those found in the Submission. As such, you have no claims or rights, including any moral rights, to any material.
If selected, your work will appear on the internet, including, but not limited to, the Accessipals™ section of scottbremner.ca.
If SYF accepts your Submission and displays it on any of the Accessipals websites, YouTube channels, or related social media accounts, your Submission must comply with the original Outline Request.
All Program hosts are subject to the following additional terms:
The content of the Submission must be created in a professional manner in general, so that the credibility of the Accesspals™ project and the objectivity of SYF are not called into question.
Submitters/Creators must not act as a spokesperson or represent Accessipals™ in any way without SYF's express prior approval. You acknowledge that SYF is under no obligation to pay you for your Submission, and your involvement in the project is voluntary, with no expectation of compensation.
Nothing contained in this agreement grants anyone the right to use Accessipals™ or SYF branding in any media, including social media accounts. The use of branding on any of your personal or commercial social media accounts, including hashtags such as #Accessipals, is subject to prior approval from a representative of Schoolyard Fun Productions. You must stop using SYF and Accessipals branding upon the end of your involvement with Schoolyard Fun Productions.
If you receive a media enquiry about your submission, you must refer the enquiry to Schoolyard Fun Productions. While you are free to speak to the media about your Submission, you acknowledge that you are not authorized to speak on behalf of Schoolyard Fun Productions or Scott Edward Bremner.
You acknowledge that there is no relationship of any type created, including, without limitation, any agency or fiduciary relationship, as between you and SYF, by submitting your Accessipals™ submission.
You release and forever discharge SYF, Accessipals™ and lead creative Scott Edward Bremner, respective parent, subsidiary, affiliated and associated companies, and their directors, officers, employees, agents, representatives, independent and dependent contractors, licensees, successors and assigns of and from any and all actions, causes of action, suits, proceedings, liability, debts, judgments, claims and demands which you may have arising out of SYF's use or rejection of the Submission.
We reserve the right to repackage your Submission in any format, including but not limited to other types of products such as mugs and clothing.
You are 18 years or older, a person with a disability or a friend, parent, sibling or loved one of somebody who has a physical or mental challenge.
You represent and warrant that:
The Submission and every one of its component elements is your own work and is wholly original with you and not copied in whole or part from any other work. You have the full right to grant the permissions given hereunder to Scott Edward Bremner, the Accessipals™ project, and Schoolyard Fun Productions (also known as SYF) and that no further permissions are required from, nor payments required to be made to any third party in connection with the use by SYF, the Submission and does not defame anyone and does not infringe on anyone's rights including intellectual property, publicity, privacy or any other rights, or violate any law, regulation or order.
You agree to indemnify SYF and Scott Edward Bremner and to repay expenses it incurs if you breach your representations and warranties above (such as a claim against SYF for rights you fail to clear in your Program).
Suppose your submission is presented as a media or digital production. In that case, Schoolyard Fun Productions will own the Program, and the Creator/Submitter grants websites associated with Scott Edward Bremner (including websites with video-sharing capabilities, such as YouTube or Substack) a royalty-free license to exhibit the Program in any media worldwide, until the permit expires as of December 31, 2030. If you are unable to grant worldwide all media rights to your Program, you must inform Scott Edward Bremner in writing, before broadcast/posting, that the Program (or an episode or section of it) is not cleared for online use.
If you no longer want SYF to exhibit the Submission, you must notify Scott Edward Bremner in writing. He may cancel your Submission at any time. Schoolyard Fun Productions may also reschedule the posting of your Submission or modify the available resources for your Submission at any time.
You acknowledge having obtained independent legal advice in connection with this agreement; failing which, you will be deemed to have voluntarily waived the right to seek such independent legal advice.
This agreement will be governed by the laws of the Province of Ontario and the laws of Canada applicable in such Province.
By submitting the Submission, you acknowledge that you have read, understood and agreed to all of its terms.
This agreement was drawn up in English at the express request of the Parties. / La présente entente a été préparée en anglais à la demande expresse des parties.
